Terms of Service
These terms apply to the Folder3 cloud backup service (the “Service”), sold at folder3.com and provided by XP International (PTY) LTD, a company registered in South Africa (“Folder3”, “we”, “us”). By creating a Folder3 account or paying for a subscription, you agree to these terms. If you are signing up for a business, you confirm that you may accept these terms on its behalf.
The short version
- Folder3 is a monthly cloud backup subscription. The Folder3 Mac app (Windows client coming) backs up your files to your Folder3 account storage, which we operate.
- You pay monthly in advance through Paystack: R300 / $20 per month for 500 GB, then R280 / $18 per extra TB per month. Unlimited Macs.
- You can cancel at any time. The Service runs until the end of the period you have paid for.
- After your paid period ends, we keep your backups for 30 days, then delete them.
- Refunds are covered by our Refund & Cancellation Policy.
1. The Service
Folder3 is a digital, subscription-based cloud backup service. The Folder3 app for Mac (a Windows client is in development) backs up the files, folders, drives, external disks and cloud-sync folders you choose to storage in your Folder3 account. Backups are encrypted and versioned, and you restore them in the app. We do not sell or ship any physical goods.
You create your account and subscription on folder3.com. The app is used only to sign in to an existing account; it does not sell subscriptions.
We may improve or change the Service from time to time. If we make a change that materially reduces what you are paying for, we will tell you in advance by email, and you may cancel under section 6.
2. Your account
- You must give accurate details when you sign up and keep your email address up to date, because we use it for billing and service notices.
- You are responsible for keeping your password and any recovery key safe, and for everything done through your account. Tell us straight away at support@folder3.com if you think someone else has access to it.
- Backups made on your Mac are encrypted before upload with a key held on your device. If you lose that key and every device holding it, we may not be able to help you restore those backups.
- You must be at least 18 years old, or have a parent or guardian accept these terms for you.
3. Acceptable use
You may use the Service only to back up and restore data that you own or have the right to store. You must not:
- store or distribute content that is unlawful, infringes anyone’s rights, or contains child sexual abuse material;
- use the Service to distribute malware, or to attack, probe or overload our systems or anyone else’s;
- try to access another customer’s account or data, or get around usage limits or billing;
- resell the Service, or use it as general file hosting or public file sharing, without our written agreement.
If you break these rules we may suspend or close your account. Where the law allows and it is reasonable, we will warn you first and give you a chance to fix the problem.
4. Prices, billing and payment
- Price: R300 per month (South Africa) or US$20 per month (international) includes 500 GB of storage. Storage above 500 GB costs R280 / US$18 per extra TB per month. There is no limit on the number of Macs on one account. Prices are listed on the pricing section of our home page.
- Billing: subscriptions are billed monthly in advance. Payments are processed by Paystack; we do not see or store your full card details.
- Storage limits and extra storage: the storage you use is everything stored in your account, including earlier versions of files. If you go over 500 GB, extra storage is charged per TB per month at the rate above, billed with your monthly subscription.
- Failed payments: if a payment fails, we will let you know. If it stays unpaid, we may pause new backups until it is paid. You can still restore your data while your account is paused.
- Price changes: we will give you at least 30 days’ notice by email before a price change. The new price applies from your next billing date after the notice period. If you do not agree, you can cancel before then.
5. Your data
Your backups belong to you. We store them only to provide the Service and do not sell them. Backups from your Mac are always encrypted before upload. Files that the Service pulls from cloud-sync services on your behalf are encrypted on our servers with keys held by us. How we handle personal information is explained in our Privacy Policy.
Folder3 is one copy of your data, not the only one. We work hard to keep backups safe and available, but you should keep your original files and at least one other copy, in line with the 3-2-1 rule.
6. Cancellation
You can cancel at any time before your next billing date by emailing support@folder3.com from your account email address. After you cancel, we will not charge you again, and the Service keeps running until the end of the period you have already paid for. Refunds are covered by our Refund & Cancellation Policy.
We may end the Service for your account by giving you at least 30 days’ notice by email, or straight away if you seriously or repeatedly break these terms. If we end it for a reason that is not your fault, we will refund any fees you paid for the period after it ends.
7. Data retention after cancellation
When your paid period ends, new backups stop. We keep your stored backups for 30 days after the end of your paid period so that you can restore anything you need or start a new subscription. After those 30 days, your backups are permanently deleted and cannot be recovered. Please restore anything you want to keep before then.
8. Availability and support
We aim to keep the Service available at all times, but there may be interruptions for maintenance, upgrades or events outside our control. Support is by email at support@folder3.com; see our Support page and Contact page.
9. Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential loss, such as lost profits, lost business or lost revenue;
- we are not liable for loss caused by events outside our reasonable control, by your breach of these terms, or by the loss of a key or password that only you hold;
- our total liability to you for any claim about the Service is limited to the fees you paid us in the 12 months before the event that led to the claim.
Nothing in these terms limits liability that cannot be limited by law, including any rights you have under the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will email you at least 30 days before it takes effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can cancel before they take effect.
11. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them.
